Article 1 – Definitions

The following definitions apply to these General Terms and Conditions:

Withdrawal Period: The period during which the consumer may exercise their right to cancel the contract.

Consumer: An individual acting outside the scope of their business or profession, who enters into a distance contract with a business.

Continuous Contract: A distance contract for a series of products or services where obligations are carried out over time.

Right of Withdrawal: The option for the consumer to cancel a distance contract within the withdrawal period.

Business: An individual or legal entity offering products or services at a distance to consumers.

Distance Contract: A contract concluded between a business and a consumer via distance communication technology.

Article 3 – Scope of Application

These General Terms and Conditions apply to all offers made by Emily & Claire New York and any contract entered into at a distance. Before finalizing a contract, these terms will be made available electronically or otherwise.

Article 4 – Offers

Offers are non-binding. Emily & Claire New York reserves the right to modify offers at any time. All offers clearly state the total cost, including shipping fees, taxes, and any additional postal or courier charges.

Article 5 – Agreement

An agreement is concluded when the consumer accepts the offer and meets the specified conditions. Emily & Claire New York will immediately confirm acceptance via email.

Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the contract within 14 days of receiving the product, without providing a reason. The consumer is responsible for the return shipping costs when exercising the right of withdrawal.

Article 7 – Costs in Case of Withdrawal

Emily & Claire New York will refund payments within 14 days of withdrawal, provided the product is returned in its original condition.

Article 8 – Customs and Taxes

Customers are responsible for complying with all applicable laws and regulations concerning the import or receipt of goods in their jurisdiction, including any customs fees, local taxes, or clearance charges.

For international shipments, Emily & Claire New York is not the official importer of products delivered outside of the United States. Customers must ensure compliance with their own country’s import regulations.

Any additional costs related to customs clearance, including administrative fees imposed by postal or courier services, are the sole responsibility of the customer.

Emily & Claire New York provides the necessary shipping documents but cannot guarantee that goods comply with local import regulations. Customers are advised to check import requirements before placing an order.

Article 9 – Compliance with U.S. Regulations

Emily & Claire New York complies with all applicable U.S. federal and state laws concerning e-commerce, consumer protection, and online payment reporting as required by the Internal Revenue Service (IRS) and other relevant authorities.

Article 10 – Compliance and Warranty

Emily & Claire New York guarantees that products comply with the contract and applicable legal requirements. Complaints regarding defects must be submitted in writing within 14 days of receipt. Products must be returned in their original packaging and condition.

Article 11 – Delivery

Orders are delivered within 30 days unless otherwise agreed. In case of delays, Emily & Claire New York will inform the consumer within 14 days from the order date.

Orders are shipped so that the customer is the recipient and legally responsible for all import procedures, where applicable.

Emily & Claire New York ensures that products are shipped in compliance with international shipping regulations but is not responsible for delays or issues during customs clearance.

Failure to comply with customs obligations does not constitute a valid reason for canceling an order or refunding payment.

Article 12 – Complaint Resolution

Complaints must be submitted in writing within 7 days of detecting the issue. Emily & Claire New York will respond within 14 days. If more time is needed, an estimated resolution time will be provided.

Article 13 – Disputes

These Terms and Conditions are governed by the laws of the State of New York, United States. Disputes will initially be resolved amicably. If necessary, disputes will be settled by the competent court in New York, NY, United States.
